1. About these terms
These Terms and Conditions govern your use of Contaminated Land Search and the purchase and use of its digital contaminated-site reports. In these terms, “we,” “us,” and “our” refer to Contaminated Land Search, and “you” refers to the person using the service or purchasing a report.
Review these terms and our Privacy Policy before purchasing. By purchasing a report, you agree to these terms to the extent permitted by applicable law. If you do not agree, do not purchase. Nothing in these terms removes rights or remedies that applicable law does not allow us to exclude.
You must be at least 18, or the age of legal majority where you live if higher, and legally able to enter into a purchase agreement. If acting for another person or organization, you must have authority to do so.
2. What the service provides
Contaminated Land Search provides an address-based search of available contaminated-site information in the United States. The free results are a preliminary area overview. A paid digital report may include the searched address, available site counts, site names, recorded contaminants, estimated distances, a map, general health information, neutral next steps, and a printable PDF option.
The free area count is not a finding that your home is contaminated. A report organizes available information; it is not a property inspection, laboratory test, exposure assessment, appraisal, title search, regulatory determination, or certification. Features and coverage depend on available source information.
3. Important environmental and health limitations
A listed site near an address does not, by itself, establish contamination at that property or exposure to any chemical. A lack of listed sites does not establish that a property is clean, safe, fully remediated, or free of environmental concerns. Historical activities, unreported releases, indoor hazards, and conditions not covered by available records may not appear.
Maps and distances are approximate and depend on address matching and recorded coordinates. They may not identify parcel boundaries, the full extent of contamination, groundwater movement, vapor pathways, or whether a property is on a former facility footprint. Record dates, status labels, and contaminant lists can be incomplete or out of date.
General health information describes possible effects associated with substances; it does not diagnose illness, estimate your personal exposure, establish causation, or predict that you or your family will experience a health effect. Case studies are historical examples, not predictions about the address you search.
Do not rely solely on a report for a purchase, sale, renovation, financing, medical decision, or legal claim. Verify relevant records with the responsible agency and consult an appropriately qualified environmental, medical, legal, or real-estate professional. A report is not a Phase I Environmental Site Assessment and does not satisfy ASTM E1527-21 or establish compliance with environmental due-diligence requirements.
4. Your information and address selection
Provide an accurate first name, email, and property address, and review the address shown before paying. Address suggestions and geocoding can produce incorrect or incomplete matches. You are responsible for selecting the property you intend to search and using an email address you are authorized to provide.
Contact details are temporarily carried in your browser session during the purchase flow. Opening another tab or clearing browser storage may require entering them again. Do not submit payment-card details to our address form or send them to our contact email.
5. Prices and payment
The report price displayed before purchase is in US dollars and is a one-time payment for the report identified at checkout, not a subscription. Review the final total on Square’s checkout page before authorizing payment. A purchase does not include future report updates, physical inspections, laboratory testing, or professional consultations unless expressly stated.
Square processes payment on its hosted checkout page under its own terms and privacy practices. We do not collect your full payment-card number or card security code through this website. Report access is provided after payment is verified; a browser redirect alone is not proof of payment.
The amount actually displayed at checkout governs the transaction. A visual countdown or promotional display does not create a subscription or authorize an additional charge. Do not assume that a price will change when a display ends unless the checkout expressly states that change.
6. Digital delivery and report access
Reports are delivered electronically through the paid report page after a verified payment and successful report generation. For these terms, you have received the information when the purchased report is successfully displayed or otherwise delivered to you. Purchasing a report does not involve shipment of a physical product.
Keep your report link confidential. It contains a private access credential, and someone you give that link to may be able to view the report and property address. Download or print a copy for your records. We do not promise permanent hosting, automatic updates, or unlimited future access.
Payment processing, external data services, browser restrictions, or technical interruptions may delay access. If you were charged but cannot access the report, contact us with the purchase date, the email used, and an order reference if available. Do not send full card details.
7. Refund and cancellation policy
No refunds once you receive the information. Because a report is a digital information product, once your purchased report has been successfully displayed or delivered, the sale is final and is not eligible for a discretionary refund or cancellation merely because you have accessed the information. This applies even if you choose not to download or print it.
After delivery, a change of mind, an address you entered or selected incorrectly, fewer sites than expected, no listed sites, or disagreement with the available findings does not qualify for a discretionary refund. Payment purchases the compilation and presentation of available information, not a promised finding of contamination or a particular site count.
This policy does not exclude remedies required by applicable law. If there is a duplicate charge, an unauthorized payment, non-delivery, or a materially defective product, contact us so we can investigate and provide a correction, restored access, or refund where appropriate or legally required. A payment alone does not mean information was delivered, and we do not treat a failed report load as delivery.
If you have paid but have not received the information, contact us promptly before making another purchase. We will review the payment and delivery status. Any refund that is approved will be handled through the payment processor, and posting times depend on Square and your financial institution. This policy does not limit legitimate payment disputes or non-waivable consumer cancellation rights.
8. Permitted use and ownership
You may view, download, and print a purchased report for your own use in evaluating the searched property, and share it privately with your household or professional advisers. Their use remains subject to the report’s limitations. Sharing a private report link also shares access, so prefer sharing a saved copy when appropriate.
Do not resell reports, scrape or bulk-extract the service, bypass payment or access controls, interfere with its operation, impersonate others, or use the service unlawfully. Do not alter a report to remove limitations or present it as a government certification, laboratory finding, or professional environmental assessment.
Our website design, original text, and report presentation are protected to the extent applicable law provides. Source records, third-party maps, and other third-party material remain subject to their respective rights. These terms do not claim exclusive ownership of underlying public facts.
9. Third-party information and services
The service relies on third-party records, geocoding, mapping, payment processing, and hosting. We do not control the accuracy, availability, or practices of those providers. Links to agencies or resources are for reference and do not imply affiliation, government approval, or vendor endorsement.
Third-party websites have their own terms and privacy policies. We may correct information or change features, but do not guarantee continuous operation, complete geographic coverage, or a particular refresh schedule for source records.
10. Disclaimers and responsibility
To the extent permitted by applicable law, the service and reports are provided on an “as available” basis without a guarantee of complete, error-free, or up-to-date environmental information or suitability for a particular decision. Information is not legal, medical, real-estate, engineering, or environmental-professional advice.
To the extent permitted by applicable law, we are not responsible for indirect or consequential losses resulting from reliance on incomplete source records or from your independent property or health decisions. Nothing in these terms limits responsibility for fraud, willful misconduct, gross negligence where it cannot be limited, or any liability or consumer right that cannot lawfully be excluded.
11. Privacy and security
Our Privacy Policy describes how information is handled during address searches and purchases. Use a device you trust, avoid sharing private report URLs publicly, and protect copies that contain personal or property information.
We may restrict access where reasonably necessary to address unlawful use, unauthorized access, or threats to the service. We do not promise that any internet service or electronic storage method is completely secure.
12. Changes, disputes, and contact
We may update these terms for future use and purchases by posting revised terms with an updated effective date. Changes do not retroactively remove rights relating to a completed purchase. Applicable law determines enforceability and any mandatory rights; these terms do not impose mandatory arbitration or waive a right to bring a legally permitted claim.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Please contact us first about an issue so we can attempt to resolve it. Questions about these terms, delivery, or refunds can be sent to connect@contaminatedlandsearch.com.
